Welcome to Cloudoora. These Terms of Service (“Terms”) govern your use of our services and products provided through the Cloudoora platform, including but not limited to web hosting, domain registration, cloud infrastructure, and related tools (collectively referred to as the “Services”).
By using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any provision, you must not use our Services.
1. Definitions
- “Cloudoora”, “we”, “our”, or “us” refers to Cloudoora and its affiliates.
- “Client”, “you”, or “your” refers to any individual or entity who purchases or uses our Services.
- “Agreement” refers collectively to these Terms of Service, the Privacy Policy, Acceptable Use Policy (AUP), and any applicable service-specific agreements.
2. Eligibility & Account Registration
- You must be at least 18 years old to register for and use our Services.
- You agree to provide accurate, current, and complete account information and keep it updated.
- You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
3. Service Provision & Availability
- Cloudoora will provide Services with reasonable skill and care.
- While we aim for 99.9% uptime, availability is subject to maintenance, outages, or factors beyond our control.
- We may modify, update, or discontinue parts of the Services with notice, where required by law.
4. Payment, Billing, and Renewals
- All fees must be paid in advance unless otherwise agreed in writing.
- You authorize Cloudoora to charge your payment method for renewals unless you disable auto-renewal.
- Unpaid invoices beyond the due date may result in suspension or termination of service.
- Certain fees (e.g., domain registration) are non-refundable once processed.
5. Acceptable Use
- You agree to comply with our Acceptable Use Policy.
- Prohibited uses include, but are not limited to:
- Hosting malicious software or malware
- Distributing spam or unsolicited bulk messages
- Engaging in illegal or infringing activities
- Hosting adult content or hate speech
- Cloudoora may suspend or terminate your account without prior notice if AUP violations are identified.
6. Data Backup & Responsibility
- Backups are provided as a courtesy on eligible plans.
- You are solely responsible for maintaining your own backups.
- Cloudoora is not liable for any data loss, regardless of the cause.
7. Suspension & Termination
- We reserve the right to suspend or terminate any account for:
- Non-payment
- Abuse or violation of policies
- Requests by law enforcement
- Any action that disrupts our network or harms other clients
- In case of termination, data may be permanently deleted without recovery.
8. Refund Policy
- Eligible hosting plans may be refunded within 30 days of initial purchase.
- Domain registrations, renewals, SSLs, and custom services are non-refundable.
- Refunds are issued only once per client and at Cloudoora’s discretion.
9. Limitation of Liability
- Cloudoora shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.
- Our total liability is limited to the amount paid by you for Services during the past 12 months.
10. Intellectual Property
- All trademarks, content, software, and platform features remain the exclusive property of Cloudoora or its licensors.
- You may not copy, modify, or distribute Cloudoora materials without written consent.
11. Governing Law
This Agreement shall be governed by the laws of the jurisdiction in which Cloudoora is headquartered. Disputes will be subject to the exclusive jurisdiction of the relevant courts in that location.
12. Modifications to Terms
We may update these Terms from time to time. Notice of changes will be posted on our website. Continued use of the Services after any modification constitutes your acceptance of the revised Terms.
