Cloudoora is committed to the protection of intellectual property rights, including trademarks, service marks, and copyrights. This policy outlines the procedures for submitting claims of infringement and provides a mechanism for resolving such disputes in accordance with applicable laws and regulations.
Note: This policy does not apply to disputes over domain name ownership. For domain-related issues, please refer to the Uniform Domain Name Dispute Resolution Policy (UDRP).
2. Trademark Infringement Claims
If you are the owner of a valid, registered trademark or service mark and believe your rights have been infringed upon by a Cloudoora customer, please submit your claim via email to: Email:abuse@cloudoora.com Subject line: Trademark Claim
To be considered effective, your trademark complaint must include:
The exact trademark, service mark, or trade name being infringed (with registration number).
The country or jurisdiction where the mark is registered.
Name, address, and telephone number of the trademark owner.
Description of goods/services covered by the mark.
Date of first use and date of first use in interstate commerce.
Description of how the mark is being infringed.
Evidence that the alleged infringer is a Cloudoora customer.
The exact location (URL, IP address, email address) where the infringement occurs.
A signed good-faith certification, under penalty of perjury, stating:
That the website/content infringes your rights;
The name of the rights holder;
The mark being infringed;
That the use is unauthorized and unjustifiable under the law.
Investigation Process
Upon receipt of a valid trademark claim, Cloudoora may:
Forward the complaint to the alleged infringer;
Temporarily disable access to the material in question;
Lock associated domain names, redirect DNS, or suspend related services;
Take additional steps at our sole discretion if the material is hosted on Cloudoora servers.
If Cloudoora determines the complaint is legitimate, further action (including account suspension) may be taken. If the claim is not validated, the content will be restored.
3. Copyright Infringement Claims
If you believe your copyright has been violated, send your complaint to: Email:abuse@cloudoora.com Subject line: Copyright Claim
Please include the following:
An electronic or physical signature of the copyright owner or authorized agent.
Identification of the copyrighted work (or list of works) in question.
Clear identification of the allegedly infringing material and its location (URL, path, etc.).
Contact details: name, address, telephone number, and email address.
A statement that you have a good faith belief the use is not authorized by law.
A statement under penalty of perjury that the information provided is accurate and that you are the rights holder or authorized to act on behalf of the rights holder.
Investigation Process
Cloudoora may:
Forward the complaint to the alleged infringer;
Lock the affected domain name(s), suspend related services;
Disable or remove the infringing content if hosted on Cloudoora infrastructure.
If the copyright claim is verified, Cloudoora will maintain any restrictions on the infringing content. If not, access will be restored.
4. Counter Notification Policy
If you believe a copyright or trademark infringement complaint was filed in error, you may submit a counter-notification to abuse@cloudoora.com, containing:
Your electronic signature.
Identification of the removed material and its previous location.
A statement under penalty of perjury that the material was removed in error or misidentification.
Your full name, physical address, phone number, and:
A declaration that you consent to jurisdiction in the relevant court where Cloudoora operates;
That you will accept service of legal process from the Complaining Party.
Upon receipt, Cloudoora will:
Provide a copy of the counter-notification to the original Complaining Party;
Restore the content no sooner than 10 business days and no later than 14 business days, unless legal action is taken by the Complaining Party to prevent restoration.
5. Repeat Infringer Policy
Cloudoora maintains a strict policy against repeat infringement. Accounts belonging to users who are the subject of multiple valid complaints may be permanently suspended without further notice.
